Privacy Policy

PRIVACY STATEMENT

This Privacy Statement applies only to the Cenergistic Web site, operated by Cenergistic.  This Privacy Statement explains to you, the User, what information is collected by Cenergistic, why the information is collected, how the collected information is used, and the choices offered by Cenergistic, including how to access and update the collected information.

I. Definitions

A. “Account” shall mean the services provided to the Registered User during a term fixed by Cenergistic including access to and usage of the Communication Services.

B. “Business Relationship” shall mean an entity with which Cenergistic has an ongoing business relationship to provide data analysis, technology hosting services, development, or maintenance of the Cenergistic Web site or to provide marketing services or specialized products or services or information to Users of the Cenergistic Web site.

C. “Communication Services” shall mean bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable Registered Users to communicate with Cenergistic, the public at large, or with a group.

D. “Cookies” are small text files containing unique identification numbers that a User’s web browser software transfers from the Cenergistic Web site to the User’s computer upon visiting the Cenergistic Web site.

E. “Cenergistic” shall mean Cenergistic, Inc., its officers, agents, affiliates, subsidiaries, and parent corporations, and all others acting on its behalf or under its control.

F.  “Personal Information” shall mean any information that identifies a User with the exception of professional information such as the User’s title, business address, business telephone number(s) and facsimile numbers and business e-mail address.

G. “Registered User” shall mean a User of the Cenergistic Web site having an Account with Cenergistic.

H. “User” shall mean any user of the Cenergistic Web not having an Account, and any Registered User.

II. The Cenergistic Web Site

The Cenergistic Web site is comprised of various Web pages, some of which are only available to Registered Users, located at the www.cenergistic.com domain name and operated by Cenergistic. 

Users can only access a public portion of the Cenergistic Web site. 

Other restricted portions of the Cenergistic can be accessed only by Registered Users.  The restricted portions of the Cenergistic Web site contain the Communication Services. Registered Users are allowed to access and use the Communication Services provided by Cenergistic after registering an Account with Cenergistic. 

III. Privacy

A. Minimum Personal Information Collected by Cenergistic, How it is Collected and Used

Account Registration - If a User has been invited by Cenergistic to become a Registered User to gain access to the restricted portion of the Cenergistic Web site that requires an Account password, the User must register the Account, at which time Cenergistic requests contact information, which may include the following Personal Information, such as: the name, telephone number(s), mailing address(es), e-mail address(es), and Account password of the User. Cenergistic may combine the Personal Information submitted through the registration of the Account with information from other Cenergistic services to provide the User with a better experience or to otherwise improve the quality of the services Cenergistic offers to Users and provides to Registered Users.

B. Optional Ways Personal Information is Collected and Used

All of the following services are optional.  If a User or a Registered User does not wish to provide Personal Information, the User or the Registered User may decline to take advantage of that service.

  1. E-mail Newsletters – When registering an Account, the option to receive a periodic e-mail newsletter and special offers from Cenergistic is pre-checked. If a Registered User does not want to receive these services, un-check the "Yes" box when registering or select the “Unsubscribe” link provided in the e-mail message.
  1. Surveys – Occasionally, Cenergistic conducts voluntary surveys through the Cenergistic Web site or directly through e-mails. These surveys may ask a Registered User for background information and preferences.  A Registered User is under no obligation to be a part of any survey.  A Registered User may at any time opt-out of an e-mail survey by accessing the “Unsubscribe” link provided in the e-mail message.  Any Personal Information Cenergistic collects through any survey is aggregated and is used to better serve Registered Users by determining Registered Users’ needs and to improve Registered Users’ satisfaction and the Cenergistic Web site.  Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), and e-mail address(es) of a Registered User.  Cenergistic does not sell any of the Personal Information gathered in these surveys but may share the results of any survey with the Business Relationship in accordance with this Privacy Statement.
  1. Seminar Registration – When registering for Cenergistic seminars, Cenergistic collects some Personal Information, including information about the preferences of a Registered User. This Personal Information may be shared with the hotel where the seminar is located, transportation services, food service providers, or other third parties associated with the seminar. Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), e-mail address(es), and shirt size of the Registered User.
  1. Contact Us – When a User completes a “Contact Us” request, Cenergistic gathers some Personal Information. This Personal Information is for internal use only and allows Cenergistic to respond to inquiries or suggestions. Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), and e-mail address(es) of a User.
  1. User Information Update – The Cenergistic Web site provides a means, as provided in Section III, paragraph E of this Privacy Statement, for a User to submit updates to the Personal Information of the User.  This Personal Information is used for internal purposes only.  Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), and e-mail address(es) of a User.
  1. Registered User Visit Request – The Cenergistic Web site provides a means for a Registered User to request a visit from the consulting staff of Cenergistic.  Any Personal Information gathered is for internal use only and allows Cenergistic to respond to any inquiry or suggestion.  Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), and e-mail address(es) of a Registered User.
  1. Career Opportunities – Cenergistic asks for only the Personal Information of a User necessary to apply for employment.  The Personal Information gathered is for internal use only. Personal Information requested may include demographic information including, but not limited to the name, address(es), phone number(s), and e-mail address(es) of a User.  Personal Information submitted as part of a job application or in a résumé is shared only with persons involved in the hiring process at Cenergistic.
  1. Registered User Generated Content – Cenergistic offers the Communication Services for Registered Users. Any content, including Personal Information, disclosed by a Registered User when posting, uploading, or transmitting to a Communication Service, including the screen name or ID of the Registered User, may become public and may be used by Cenergistic for online and offline promotional or commercial uses in any and all media.
  1. User Communications – When sending any electronic communication, including but not limited to any e-mail or any other communication, including but not limited to any telephone, written, or verbal communication to Cenergistic, Cenergistic may retain such electronic or other communication in order to process inquiries, respond to requests, and improve the services of Cenergistic.
     

In addition to the above, the purposes for which Cenergistic uses Personal Information include, but are not limited to:

  • Providing services to Registered Users;
  • Auditing, research, and analysis in order to maintain, protect, and improve the services of Cenergistic;
  • Ensuring the functionality of the Cenergistic network, including but not limited to the Cenergistic Web site and the Cenergistic server; and,
  • Developing new services.

C. Personal Information Shared and With Whom Shared

Under certain agreements Cenergistic may make portions of Personal Information available to third party organizations as follows:

1. Business Relationships

a. Statcounter Ltd, having a place of business at Guinness Enterprise Center, Taylor’s Lane, Dublin 8, Ireland (“Statcounter”), is a third party analytic service provider that gathers and analyzes the activities of a User on the Cenergistic Web site.  Statcounter assists Cenergistic by delivering the most relevant services and information to a User. The information Cenergistic shares with Statcounter is anonymous, meaning that no identifiable Personal Information will be received by or shared with Statcounter.

b. Google Analytics is a third party analytic service offered by Google, Inc., a Delaware corporation and having a corporate headquarters at 1600 Amphitheatre Parkway, Mountain View, California 94043 (“Google Analytics”), that generates statistics of activities of a User on the Cenergistic Web site.  Google Analytics assists Cenergistic by delivering the most relevant services and information to a User.

2. Other Companies

Cenergistic may sell, transfer, or otherwise disclose Personal Information, including but not limited to any User’s name, mailing address, telephone number, and e-mail address in connection with a fundamental corporate change such as a merger, acquisition, consolidation, or any form of sale of some or all of the assets of Cenergistic.

D. Disclosure For Other Reasons

Cenergistic may disclose the Personal Information of a User to third parties outside of Cenergistic if Cenergistic has a good faith belief, determined in its sole discretion, that access, use, preservation, or disclosure of such Personal Information of a User is reasonably necessary to: (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request; (b) enforce any applicable third party terms of use, including investigation of potential violations thereof; (c) detect, prevent, or otherwise address fraud, security, or technical issues; (d) protect the interests, rights, or property of Cenergistic; or (e) protect the personal safety or property of any Registered User, User, or the public as required or permitted by law.

E. User Control of the Use of Personal Information by Cenergistic

If a User desires to change the Personal Information of the User in the records of Cenergistic and/or to remove the name of the User from lists Cenergistic shares with third parties pursuant to this Privacy Statement, including a postal mailing list the User may contact Cenergistic using one of the methods set forth below.

  1. E-mail Cenergistic at: websupport@cenergistic.com, and include name, address, telephone number, e-mail address, and a note of instruction; or
  1. Call Cenergistic at 214.273.2800; or
  1. Write to Cenergistic at: Cenergistic, Inc., Attention Web Support, 5950 Sherry Lane, Suite 900, Dallas, Texas 75225, and include name, address, telephone number, and a note of instruction; or
  1. If a User has a registered Account, the User can access "Your Account" to update the Personal Information of the User.
  1. Control of E-mail Marketing Received From Cenergistic

A Registered User may cancel e-mail newsletters received from Cenergistic at any time by selecting the “Unsubscribe” link provided in each e-mail message or un-check the "Yes" box next to “e-mail messages” after accessing "Your Account."

 

IV. Technical Information

A. Use of Cookies by Cenergistic

  1. Cenergistic collects information about how Users navigate through the Cenergistic Web site upon visiting the Cenergistic Web site. For example, and not by limitation, Cenergistic uses Cookie technology to track which pages on the Cenergistic Web site a User views and which web browsers are used by each User.  Cenergistic analyzes this information in aggregate - that is, Cenergistic collects this information and analyzes it as a whole.  Cenergistic uses this information to improve the Cenergistic Web site by making the Cenergistic Web site more responsive to the needs and preferences of Users.  On occasion, Cenergistic may share this aggregate information with the Business Relationships or other third parties to indicate to the Business Relationships or other third parties the amount of interest in the Cenergistic Web site and to help Cenergistic plan for technical improvements.  This aggregated information will not identify any User of the Cenergistic Web site.
  1. Cenergistic uses Cookies when an Account is registered on the Cenergistic Web site to record the specified area of interest of a Registered User and any other information voluntarily provided and saved by a Registered User upon each visit to the Cenergistic Web site, and for no other purpose.
  1. Cenergistic uses Cookies to understand traffic patterns on the Cenergistic Web site to determine the interests and needs of a User, and to identify ways to improve the Cenergistic Web site by adding products and services that a User has indicated by the preferences of the User that will benefit the User. These Cookies identify the computer of the User and not the e-mail address of the User.

B. Collection of Analytical Data

  1. Statcounter may use Cookies on behalf of Cenergistic and may receive information about the browsing activity of a User on the Cenergistic Web site.  Statcounter also collects certain technical information from the computer of a User each time the User requests a page during a visit to the Cenergistic Web site.  This information may include, but is not limited to the Internet Protocol (IP) address of the User, the operating system of the computer of the User, the browser used by the User, and the address of a referring Web site, if any.  Statcounter collects this information to assist Cenergistic in enhancing the quality of a User’s experience during the User’s visit to the Cenergistic Web site and will not sell or rent this information.  Statcounter is prohibited from using, in any manner, any information obtained in the course of providing these services to Cenergistic, other than to provide the services for which Cenergistic and Statcounter have agreed upon.
  1. Google Analytics may use Cookies on behalf of Cenergistic and may receive information about the browsing activity of a User on the Cenergistic Web site.  Google Analytics also collects certain technical information from the computer of a User each time the User requests a page during a visit to the Cenergistic Web site.  This information may include, but is not limited to the Internet Protocol (IP) address of the User, the operating system of the computer of the User, the browser used by the User, and the address of a referring Web site, if any.  Google Analytics collects this information to assist Cenergistic in enhancing the quality of a User’s experience during the User’s visit to the Cenergistic Web site.
  1. Cenergistic collects information directly from the Cenergistic Web site. This information includes, but is not limited to: page views, affiliate referrals, site referrals, User frequency, and User registrations.

V. Security

A. Protection of Personal Information

Cenergistic has corporate policies and procedures in place for the electronic security of any information collected from the Cenergistic Web site.  Secure Socket Layer technology (“SSL”) is used to keep others from intercepting User information while the User information is transmitted through the Internet. SSL technology is the industry standard method of communicating secure online transactions and is built into most major browsers. All information, including Personal Information, once on the Cenergistic server, is protected from any external intrusions via firewall technology. Only Cenergistic employees who require the Personal Information to serve any User have access to the User’s Personal Information, which is password protected.  Cenergistic employees who have access to Personal Information are trained in the privacy and security practices of this Privacy Statement.

B. E-Mail Abuse

Cenergistic will rarely, if ever, request Personal Information in an unsolicited e-mail message to a User.  Spammers can use numerous methods that to hide their identity by using others’ e-mail address to send out e-mails, including fabricating an e-mail to make the e-mail appear to originate from Cenergistic.  These spammers may be engaging in a practice known as “phishing”, in which a spammer will attempt to deceive an unwary recipient of the fabricated e-mail into disclosing Personal Information.  

If a User has any question about the genuineness of an e-mail the User receives that appears to be from Cenergistic, contact Cenergistic at websupport@cenergistic.com and do not disclose any Personal Information in response to the e-mail, unless the authenticity of the e-mail can be verified.

C. Transaction Security

Secured communications on the Internet require attention to authentication, encryption, and data integrity.  All three are addressed by the SSL protocol. Authentication is the process of establishing that a User is communicating with the Cenergistic server, as opposed to another server assuming the identity of Cenergistic.  Cenergistic has obtained a GoDaddy.com™ digital security certificate for the Cenergistic Web site.  GoDaddy.com™ is an independent third party that authenticates the identity of others on the Internet.  The GoDaddy.com™ certificate confirms that Cenergistic is the recipient of User communication.  Encryption is the process of scrambling data (through the use of keys and mathematical encoding algorithms) to prohibit anyone from understanding the data if intercepted while being transmitted from a User’s browser to the Cenergistic server. Encryption protects communications between a User’s browser and the Cenergistic server.  Cenergistic has also implemented a firewall to protect all of Cenergistic’s systems from intrusion. Data integrity ensures that the data passed between a User’s browser and the Cenergistic server is not being tampered with while in transit.  SSL protects information in transit to Cenergistic and the GoDaddy.com™ certificate confirms that Cenergistic the recipients of this information.

No data transmission over the Internet or any wireless network can be guaranteed to be absolutely secure.

To ensure a User is in SSL or secure mode for any transaction, the address of the web page will indicate the SSL or secure mode.  Secure pages will usually appear with an address that begins with https:// rather than the standard http://.

CENERGISTIC DOES NOT WARRANT OR ENSURE THE SECURITY OF ANY INFORMATION SENT TO CENERGISTIC TO AND/OR THROUGH THE CENERGISTIC WEB SITE.

VI. Miscellaneous

A. Cenergistic Policies Regarding Children

Cenergistic does not intend to collect any information from children.  Do not submit any information regarding any person, including any user under eighteen (18) years of age. Cenergistic will not knowingly collect Personal Information about any person under thirteen (13) years of age.  If a User believes that Cenergistic has information from or about anyone under 13 years of age, the User may notify Cenergistic by e-mail at websupport@cenergistic.com or by telephone at 214.273.2800.

B. Links to Other Web Sites

Cenergistic provides links to third party Web sites for the convenience of a User. These third party Web sites operate independently of Cenergistic and have established their own privacy and security policies. For the best online experience, Cenergistic encourages Users to review these policies before submitting any Personal Information through these third party Web sites. Cenergistic is not responsible for the privacy, terms of use, or other policies of any other Web site or their management of your Personal Information.

C. Consent to Transfer

The Cenergistic Web site is operated in the United States.  Any information a User provides to Cenergistic will be transferred to the United States.  By using the Cenergistic Web site and/or providing Cenergistic with the Personal Information of a User through the Cenergistic Web site, the User consents to this transfer.

D. Updates to this Privacy Statement

Cenergistic reserves the right to make changes at any time to any Cenergistic Policy, including but not limited to this Privacy Statement, and/or alter the look and functionality of the Cenergistic Web site.  If the use of Personal Information by Cenergistic is changed, Cenergistic will update this Privacy Statement accordingly and post such changes on this Web page. You, the User, are responsible to regularly review this Privacy Statement for the latest information on privacy and security policies.
